Data protection declaration

1. Information on the collection of personal data

(1) In the following, we inform about how we collect your personal data as you use this website. Personal data are all those that can be related to a person, e.g. name, address, email address, user behaviour.

(2) The controller as per art. 4 para. 7 of the General Data Protection Declaration (GDPR) is Cocoon GmbH Product Meets Competence, Am Amselsberg 5a, 99441 Magdala OT Göttern, info@cocoon-competence.de (see our imprint).

(3) When you get in touch with us by email or using the contact form, the data you send us (email address, name and telephone number) are stored by us so we can answer your questions. We delete the data connected with this as soon as its storage is no longer required or restrict its processing if there are legal retention obligations.

(4) If we commission service providers to carry out some functions within our provision or wish to use your data for advertising purposes, we will inform you below in detail of the processing in question. We will also name the set criteria for retention limits.

(5) The data we process are deleted or restricted in processing as per art. 17 and 18 GDPR. If not expressly stated within this data protection declaration, the data we store will be deleted as soon as they are no longer required for their purpose and no statutory retention limits countermand their deletion. If the data are not deleted because they are needed for other, legally permissible purposes, their processing will be restricted. This means the data will be locked and not used for other purposes. This applies e.g. to data whose retention is required by commercial or tax law.

2. Your rights

(1) You have the following rights relating to your personal data: You have the right of access to information about the personal data we keep about you. If requests for information are not made in writing, we ask for understanding that we may need to request proof of identity from you to ensure you are the person you say you are. You also have the right to rectification or erasure and restriction of processing, if this is legally available to you. You can also object to processing of your data within the legal limits. The same applies to your right to data portability.

(2) You also have the right to complain to a supervisory authority regarding the processing of your personal data by us.

3. Collection of personal data during visits to our website

(1) If you simply use the website for information, that is, if you do not register or send us other information, we will only collect the personal data your browser sends to our servers. If you want to view our website, we collect the following data technically required by us to display it and ensure its stability and security (legal basis is art. 6 para. 1.1 (f) GDPR):

– IP address
– Date and time of the request
– Time zone difference to Greenwich Mean Time (GMT)
– Content of the request (concrete page opened)
– Access status/HTTP status code
– Data quantity transferred
– Website from which the request is made
– Browser
– Operating system and its interface
– Language and version of the browser software.

For security reasons (e.g. to solve cases of misuse or fraud), these data are stored for a maximum of 14 days, then deleted. Data whose further retention is required for evidentiary purposes are excluded from deletion until the case in question is resolved.

(2) In addition to the abovementioned data, cookies are stored on your device when you use our website. Cookies are small text files stored on your hard drive and assigned to the browser you use and using which the party setting the cookie (here, us) is provided with certain information. Cookies cannot execute programs or transfer viruses to your computer. They serve to make internet provision more user-friendly and effective.

(3) Use of cookies:

a) This website uses the following types of cookies whose extent and functioning are explained below:

– transient cookies (see b)
– persistent cookies (see c).

b) Transient cookies are deleted automatically if you close the browser. These include, in particular, session cookies. These store a so-called “session ID” using which various requests by your browser can be assigned to the same session. This means your computer can be recognised again when you return to our website. The session cookies are deleted when you log out or close the browser.

c) Persistent cookies are automatically deleted after a given period that can vary from cookie to cookie. You can delete the cookies at any time using the security settings in your browser.

d) You can configure your browser settings as you desire, say, to accept or decline acceptance of third-party or all cookies. Here, we make indication that if you do so, you may not be able to use all the functions of this website.

4. Objection or revocation of consent to the processing of your data

(1) If you have consented to the processing of your data, you can revoke consent at any time. Such revocation influences the permissibility of processing of your personal data after you have issued it to us.

(2) If we justify the processing of your personal data on the basis of the balance of interests, you can object to such processing. This is the case when processing is not required for the fulfilment of a contract with you, something shown by us in the subsequent description of functions. If you exercise your right to object, we request you give reasons why the personal data cannot be processed by us. If you justify your objection, we will assess the situation and either stop or adjust processing or inform you of our urgent and overriding reasons for continuing it.

5. Use of Google Analytics

(1) So we can design our websites as needed, we create pseudonymous user profiles with the aid of Google Analytics. Google Analytics uses persistent cookies stored on your terminal and readable to us. In this way we can recognise repeat visitors as such and find out how often our pages are visited by various different users. Such data processing takes place on the basis of art. 6 para. 1 (a) GDPR (consent).

(2) The information generated by the cookie regarding your use of our website is, as a rule, transferred to a Google server in the USA and saved there. As we have activated IP anonymisation on our website, your IP address will be truncated by Google beforehand within a member state of the European Union. Only in exceptional cases is the full IP address transferred to a Google server in the USA (an appropriate level of data protection as per art. 45 para. 1 GDPR is provided by Google’s participation in the EU-US Privacy Shield) and first truncated there (for further information on the purpose and extent of data processing see e.g.https://policies.google.com/privacy?hl=de&gl=de). We have concluded a data processing contract with Google LLC (USA) as per art. 28 GDPR. Under this, Google will only use the information gathered for the strict purpose in question, to evaluate the use of our website for us and create reports about website activity.
